Yanis Saputra, S.H.I., M.H.<\/strong><\/p>\n<p style=\"margin: 10px 0px; font-size: 14px;\"><strong style=\"font-weight: bold;\">Pendahuluan<\/strong><\/p>\n<p style=\"margin: 10px 0px; font-size: 14px; text-align: justify;\">Fenomena kekerasan dalam rumah tangga (KDRT) terus menjadi masalah serius di Indonesia. Setiap tahun, ribuan kasus dilaporkan kepada Komnas Perempuan, dengan perempuan sebagai korban terbanyak. Ironisnya, di tengah upaya hukum modern untuk melindungi korban, ada sebuah konsep dalam diskursus agama yang sering disalahpahami dan berpotensi memicu kekerasan, yakni kata nusyuz. Secara tradisional, nusyuz diartikan sebagai &#8220;pembangkangan istri terhadap suami.&#8221; Namun, penafsiran yang sempit dan keliru ini sering kali digunakan sebagai pembenaran untuk tindakan kekerasan, baik fisik maupun psikologis, yang dilakukan oleh suami. Pemahaman seperti ini tidak hanya bertentangan dengan semangat keadilan dalam Islam, tetapi juga merusak tatanan keluarga dan hak-hak asasi manusia. Oleh karena itu, diperlukan reinterpretasi mendalam terhadap konsep nusyuz. Artikel ini akan mengupas tuntas mengapa pemahaman ulang ini sangat krusial, dengan mempertimbangkan realitas sosial di Indonesia dan kerangka hukum modern yang ada.
