Perspektif fikih konvensional nusy&uacute;z dikonotasikan pembangkangan isteri terhadap suami, karena dipengaruhi patriarkhi budaya Arab pra-Islam. Instruksi Presiden Nomor 1 Tahun 1991 tentang Kompilasi Hukum Islam di Indonesia menyebut nusy&uacute;z dalam Pasal 80, 84 dan 125, hanya mengatur nusy&uacute;z isteri dan sanksi hukumnya, sementara nusy&uacute;z suami tidak disinggung. Terdapat ambivalensi, ambiguity danketidakadilan hukumbagi isteri.Fokus penelitian ini yaitu rekonstruksi konsepsi nusy&uacute;z dalam KHI dan korelasinya dengan perkembangan hukum keluarga di Indonesia. Jenis penelitian library research dengan pendekatan analisis kesetaraan gender. Hasil penelitian ini menunjukkan perlu penataan ulang konsepsi nusy&uacute;zdalam KHI .<\/em><\/p>\n<p style=\"margin: 10px 0px; font-size: 14px; text-align: center;\"><em>Kata kunci: Nusy&uacute;z, fikih, gender.<\/em><\/p>\n<p style=\"margin: 10px 0px; font-size: 14px; background-color: #f2f2f2;\">A.Latar Belakang Masalah<\/p>\n<p style=\"margin: 10px 0px; font-size: 14px; text-align: justify;\">Nusy&uacute;zmerupakan salah satu topik pembahasan dalam bidang hukum keluarga, konsepnya belum tuntasdibicarakan pada masa awal-awalIslam. Istilah nusy&uacute;z yang telah terserap menjadi bahasa hukum Indonesia merupakan bahasa al-Qur&rsquo;an dengan berbagai derivasinya. Pemahaman fikih tentang nusy&uacute;z bersinggungan dengan konteks sosial-budaya masyarakat Arab sebaagi sebab khusus turunnya Q.S.an-Nis&aacute;a&rsquo; [4]:34. Kondisi geografis yang agraris tanah Arab menempatkan laki-laki sebagai otoritas tunggal mencari nafkah keluarga dan di medan peperangan. Dua kenyataan tersebut menimbulkan settingbudaya patriarkhi yang melahirkan asumsi kolektif; laki-laki lebih kuat dari perempuan. Bahkan dalam sistem hukum dan perundang-undangan, khususnyadalamhukum keluarga di berbagai negara masih sarat dengan muatan-muatan(materi)yangbelummelindungidanmemberikanhak-hakyangadilbagiperempuan(Wahid,2014).<\/p>\n<hr style=\"margin: 1em 0px;
