Keduanya dibedakan berdasarkan intensitas pelanggaran terhadap unsur-unsur konstitutif perkawinan, yakni rukun dan syarat. Nikah b\u0101\u1e6dil adalah akad yang rusak secara substansial pada rukun atau syarat esensialnya, sehingga tidak melahirkan akibat hukum sama sekali. Sebaliknya, nikah f\u0101sid adalah akad yang secara prinsip memiliki legitimasi syar&lsquo;i, tetapi cacat pada syarat pelengkap (syur\u016b\u1e6dal-kam\u0101l) sehingga akibat hukumnya terbatas. Meskipun demikian, dalam praktik fikih, kedua istilah ini kerap dipertukarkan, khususnya oleh jumhur ulama yang menganggap keduanya sama-sama tidak sah secara hukum.<\/span><\/p>\n<p style=\"margin: 10px 0px; font-size: 14px; text-align: justify;\"><span style=\"font-size: 12pt;\">Dalam sistem hukum positif Indonesia, terminology f\u0101sid dan b\u0101\u1e6dil tidak dikenal secara eksplisit. Namun, substansi pengaturannya tercermin dalam norma sahnya perkawinan dan larangan-larangan perkawinan sebagaimana diatur dalam Pasal 2 ayat (1) Undang-Undang Nomor 1 Tahun 1974 yang menyatakan:<\/span><\/p>\n<p style=\"margin: 10px 0px; font-size: 14px; text-align: justify;\"><span style=\"font-size: 12pt;\">&ldquo;Perkawinan adalah sah, apabila dilakukan menurut hukum
